These Terms and Conditions ("Terms") govern your use of the services provided by the GiveWin Corporation ("GiveWin") through its platform. By accessing or using the GiveWin platform, you agree to abide by these Terms.

Fundraiser Participation and Compliance:

  • Participants must adhere to all applicable laws, rules, and regulations.
  • GiveWin will promptly respond to communications, concerns, and complaints from participants.
  • Compliance with applicable laws, Terms, and Fundraiser Rules is mandatory, including personal information handling.
  • Refunds or credits will be issued as required by law and Fundraiser Rules.

Purchases and Payments:

  • Payments are processed through Stripe Inc. ("Stripe").
  • Users agree to provide accurate payment and billing information.
  • Service fees and other processing fees may apply.
  • Users authorize Stripe to charge applicable fees and taxes.

User Content:

  • Users grant GiveWin a license to use submitted content for platform and promotional purposes.
  • GiveWin is not responsible for the accuracy or legality of user-generated content.

Disclaimers:

  • GiveWin does not guarantee the accuracy or quality of content on its platform.
  • Users assume all risks associated with using the platform.

Advertising and Linked Websites:

  • GiveWin is not responsible for third-party websites linked on its platform.
  • Users access third-party websites at their own risk.

Availability, Security, Monitoring, and Investigations:

  • GiveWin does not guarantee uninterrupted or error-free access to its platform.
  • Users are responsible for maintaining their own internet access and equipment.
  • GiveWin reserves the right to monitor activity on its platform and investigate violations of these Terms.

Restrictions, Obligations, and Code of Conduct:

  • Users must comply with all applicable laws and regulations.
  • Prohibited conduct includes unauthorized account access, reverse-engineering, and unsolicited advertising.
  • Users must not collect personal information of other users without permission.

General Disclaimer and Limitation of Liability:

  • GiveWin and its affiliates are not liable for any damages arising from platform use.
  • Liability is limited to Five Canadian Dollars ($5.00 CAD).

Indemnification:

  • Users agree to indemnify GiveWin against any claims arising from their platform use.

Governing Law:

  • These Terms are governed by the laws of Ontario, Canada.
  • Disputes will be resolved in the courts of Toronto, Ontario.

Copyright Dispute Policy:

  • Residents of Canada and the United States can report copyright infringement to GiveWin.

Termination and Suspensions:

  • GiveWin may suspend or terminate user access for violations of these Terms.

Miscellaneous:

  • Users may not assign these Terms without GiveWin's consent.
  • Waivers of rights or remedies must be in writing.
  • If any provision of these Terms is found unenforceable, the remaining provisions remain valid.
  • These Terms constitute the entire agreement between the user and GiveWin.

Questions, Concerns, and Suggestions:

  • Users can contact GiveWin with inquiries or feedback.

By using the GiveWin platform, you agree to these Terms and acknowledge your responsibility to comply with them. If you do not agree with these Terms, you must refrain from using the platform.

GiveWin Terms and Conditions

1. Introduction

The Platform is provided by the GiveWin Corporation (GiveWin) and is licensed to you, the user, under the terms and conditions outlined in this Agreement. By accessing and using the Platform, you agree to abide by these terms and conditions.

2. Modification of Terms

GiveWin reserves the right to modify the terms and conditions of this Agreement at any time and in its sole discretion. Any changes will be effective upon posting on the Platform, and your continued use constitutes acceptance of such modifications.

3. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose data, including personal information.

4. Definitions

  • Intellectual Property: All proprietary rights, tangible or intangible, subject to Intellectual Property Rights.
  • Intellectual Property Rights: Rights provided under patent, copyright, trademark, and other laws.
  • Platform: Browser-based access to the Software provided by RNC.
  • RNC System: The Software, server(s), and related infrastructure.
  • Software: The application software for the Platform.
  • Your Data: Any data, files, or information uploaded by you to the Platform.

5. Ownership of Intellectual Property

GiveWin owns all worldwide rights, title, and interest in the Platform, including all Intellectual Property Rights. Users do not acquire any ownership interests.

6. Provision of Platform

GiveWin grants users a limited, non-transferable, non-exclusive right to access and use the Platform for participating in raffles. Any breach of this Agreement may result in termination of access.

7. Use Restrictions

Users shall not:

  • Transmit files containing viruses or similar software.
  • Probe, scan, or test the Platform’s vulnerability.
  • Engage in illegal activities.
  • Use any automated means without GiveWin's prior approval.
  • Use the Platform for purposes other than participation in raffles.
  • Use GiveWin's name without express permission.

8. Audits and Unauthorized Use

GiveWin reserves the right to monitor and audit user activity. Unauthorized use may result in denial of access to the Platform.

9. Viruses

GiveWin may remove any data containing viruses. Users are responsible for associated costs.

10. Age and Responsibility

Users represent that they are of legal age to engage in gambling activities and accept financial responsibility for Platform use.

11. Disclaimer of Warranty

The Platform is provided "as is" without warranties. GiveWin makes no representations regarding validity or scope of Intellectual Property Rights.

12. Limitation of Liability

GiveWin will not be liable for any damages arising from Platform use.

13. Indemnity

Users agree to indemnify and hold GiveWin harmless from any claims arising from Platform use.

14. Links

GiveWin is not responsible for the content of linked websites.

15. Security Requirements

GiveWin implements safeguards to protect user data. Users grant GiveWin a limited license to hold and process their data.

16. Changes

GiveWin may make changes to comply with statutory requirements or operational needs.

17. General Provisions

This Agreement constitutes the entire agreement between the parties. All questions should be directed to GiveWin Corporation.

18. Governing Law

This Agreement shall be governed by the laws of the Province of Ontario, and any disputes shall be resolved in the courts of Ontario.
